1. General Compliance Declaration
Cosphoria (the "Website") is not based within the jurisdiction of the United States. However, the operators of the Website have elected to voluntarily comply with the record-keeping requirements of 18 U.S.C. § 2257 and/or 28 C.F.R. Part 75.
All models, actors, actresses, and other persons who appear in any visual depiction of actual or simulated sexually explicit conduct appearing on or otherwise contained in this Website were at least 18 years of age at the time of the creation of such depictions.
Third-Party Content
The Website operates as a hosting service that allows third-party users to upload content ("user generated content"). The operators of the Website are not the "producers" of any User Generated Content as defined in 18 U.S.C. § 2257.
- The Website limits its handling of such content to transmission, storage, retrieval, hosting, or formatting.
- All User Generated Content is uploaded and under the control of the respective third-party user.
- Pursuant to 18 U.S.C. § 2257(h)(2)(B)(v), the Website reserves the right to delete materials that are deemed inconsistent with our terms of service or that fail to comply with applicable laws.
2. Exempt Content
Certain depictions are exempt from Section 2257 requirements, including but not limited to::
- Content that does not portray conduct specifically listed in 18 U.S.C. §2256(2)(A)(i)–(iv).
- Content that does not portray conduct listed under 18 U.S.C. §2257A, produced after March 19, 2009.
- Content that does not portray conduct listed in 18 U.S.C. §2256(2)(A)(v), produced after March 19, 2009.
- Visual depictions created before July 3, 1995.
- Content where the company does not act as a “producer” as defined in 28 C.F.R. §75.1(c).
3. User Agreements
As a condition of use, all users of the website are contractually bound to warrant and represent that:
- They are at least 18 years of age (or the age of majority in their jurisdiction, whichever is higher).
- For any content depicting actual sexually explicit conduct, they are the "producer" as defined by 18 U.S.C. § 2257 and have complied with all requirements of the statutes, including maintaining complete and accurate records as required by law.
- For any content depicting simulated sexually explicit conduct or other exempted content, they have determined the applicable exemptions and maintain the required records pursuant to 18 U.S.C. § 2257A.
- All models depicted in any content were at least 18 years of age at the time of its creation.
4. Reporting Non-Compliant Content
We maintain a zero-tolerance policy for illegal content. If you discover any material on this Website that depicts minors, non-consensual activity, or otherwise violates 18 U.S.C. § 2257, please report it immediately to us in here. We will investigate and remove offending content expeditiously.
